Terms of electronic services

§ 1. Who provides the services

The provider is SHEF-POVAR CATERING SP. Z O.O., ul. Cylichowska 84, 04-769 Warszawa, NIP 5213941166 · REGON 520104820 · KRS 0000924592.

These terms set out how the site may be used. They are provided free of charge, in a form that can be downloaded, reproduced and stored.

§ 2. Definitions

• Site – the provider’s website together with its language versions.
• User – anyone using the Site.
• Consumer – a natural person entering into a contract not directly related to their business or professional activity.
• Enquiry – a message sent through the form on the Site.
• Catering service – a service provided under a separate contract, as described in § 7.

§ 3. What we provide electronically

Electronically, the provider offers only free services:

• access to the Site’s content – information about the offer, past work and contacts;
• the enquiry form – the ability to send an enquiry and receive a reply;
• marketing messages – news about offers and events, sent only to those who gave separate consent.

The provider does not sell anything on the Site and does not take payments. Sending an enquiry is not an order and binds neither party.

§ 4. Technical requirements

To use the Site you need a device with internet access and a current browser with JavaScript enabled. To receive a reply you need a working email address or phone number.

The provider notes that using the internet carries the usual risks, such as malicious software or interception of traffic. The Site is served over an encrypted connection.

§ 5. Starting and ending the agreement

1. The agreement to access the Site’s content begins when you open it and ends when you leave. No declarations are needed.

2. The agreement to handle an enquiry begins when the form is submitted and ends when a reply is given, or earlier if you withdraw the enquiry.

3. The agreement to receive marketing messages begins when consent is given and ends when it is withdrawn. Consent may be withdrawn at any time, without giving a reason, by writing to the contact address.

4. All of the above are free of charge and may be ended by the User at any time.

§ 6. Content that is not allowed

Users may not supply unlawful content, in particular content infringing the rights of others, offensive or misleading content, and may not use the form to send unsolicited commercial messages.

The provider may leave an enquiry breaching these rules without a reply.

§ 7. Catering services – a separate contract

These terms do not govern the catering service itself. Catering is provided under a separate contract, agreed and signed individually with each client – its scope, date, menu, price and payment terms come from that contract, not from the Site.

Information on the Site, including the format descriptions, is not an offer within the meaning of the Polish Civil Code, but an invitation to enter into a contract.

A Consumer receives all information required by the Consumer Rights Act – including about the right of withdrawal or its exclusion – before entering into the catering contract, together with its text.

§ 8. Complaints

1. Complaints about the Site and the electronic services may be sent to kontakt@savorthecatering.pl or in writing to the registered address.

2. A complaint should identify the person making it, describe the problem and state the expected resolution.

3. The provider handles complaints within 14 days of receipt and replies by the same channel the complaint arrived through.

4. Complaints about a delivered catering service are handled under the contract described in § 7.

§ 9. Consumer rights

1. The electronic services are free of charge and the User may stop using them at any moment, which makes a right of withdrawal meaningless in practice.

2. A Consumer may use out-of-court complaint and redress procedures, in particular the permanent consumer arbitration court or the provincial inspector of the Trade Inspection, or seek help from the district consumer ombudsman. Using them is voluntary for both sides.

3. Nothing in these terms limits consumer rights arising from mandatory provisions of law.

§ 10. Personal data

How personal data is handled – purposes, legal bases, retention and the rights of data subjects – is described in the Privacy policy.

§ 11. Copyright

The content of the Site, including texts and photographs, is protected by copyright and belongs to the provider or is used under rights held by it. Copying and distribution require the provider’s prior consent.

§ 12. Changes and final provisions

1. The provider may change these terms for important reasons, in particular a change in the law or in the scope of services. The amended terms are published on this page with the date they take effect.

2. Services started before a change remain governed by the previous wording.

3. Matters not covered here are governed by Polish law, in particular the Civil Code, the Act on Providing Services by Electronic Means and the Consumer Rights Act.
